UFC GYM Membership Terms and Conditions

UFC GYM KSA

Preamble

These Terms and Conditions govern the relationship between Miqdam Sports Company, the operator of UFC GYM KSA (the “Club”), and the member, or the member’s legal guardian where the member is under eighteen (18) years of age (the “Member”). These Terms and Conditions form an integral part of the Membership Agreement and shall be interpreted and applied in a manner consistent with the laws and regulations applicable in the Kingdom of Saudi Arabia and the Consumer Protection Charter for Sports Centres and Gyms. In the event of any conflict, the applicable mandatory legal provision shall prevail.

(1): Membership and Execution of the Agreement

  1. Membership shall be subject to the Club’s approval upon completion of the registration requirements and payment of the applicable fees or approval of the agreed payment method.
  2. Membership shall not commence until the Membership Agreement has been signed and the Member has been provided with a copy of the Agreement and these Terms and Conditions.
  3. Where the Member is under eighteen (18) years of age, the parent or legal guardian shall sign on the Member’s behalf and shall be responsible for the accuracy of the information and required consents, without prejudice to the Club’s obligation to maintain appropriate safety and supervision requirements.
  4. The Membership Agreement shall include, at a minimum, the Member’s details, contact and emergency contact details, operating days and hours, membership commencement date and term, membership category, permitted branches, fees, the parties’ rights and obligations, and the circumstances and consequences of termination.

(2): Trial Period and Cancellation

  1. If the Club does not provide the Member with a complimentary trial day prior to contracting, the Member shall have the right, on one occasion only, to cancel the Membership within twenty-four (24) hours from the Membership commencement date and receive a full refund of all fees paid.
  2. Cancellation or termination requests shall be submitted through the Club’s official approved channels. The Member shall be provided with written or electronic confirmation of receipt of the request and the actions taken in relation thereto.
  3. The cancellation right during the above period shall not prejudice the Member’s right to terminate, obtain a refund, or receive compensation in circumstances prescribed by applicable laws or these Terms and Conditions.

(3): Fees, Prices and Payment

  1. Membership fees and benefits stated in the Membership Agreement shall be final for the agreed term, subject to the cancellation, refund and compensation provisions set out in these Terms and Conditions and applicable laws.
  2. Prices shall be inclusive of Value Added Tax in accordance with the laws applicable in the Kingdom of Saudi Arabia, unless the Membership Agreement expressly provides otherwise.
  3. Any subsequent change in prices shall not apply to an existing Membership except upon renewal or with the Member’s consent.
  4. Fees for personal training, mixed martial arts classes and additional services shall be subject to the terms and prices announced at the time of enrolment, without prejudice to the Member’s statutory rights to cancellation, refund or compensation where the Club breaches its material obligations or in other cases prescribed by law.

(4): Membership Transfer

  1. If the Club offers a membership transfer service, membership may be transferred once only during the Membership term, subject to the following conditions:
    • Payment of a transfer fee of SAR 280, inclusive of Value Added Tax.
    • At least fifty per cent (50%) of the original Membership term must remain.
    • The new member must agree to these Terms and Conditions.
    • The new member must satisfy the registration and membership requirements.
  2. Discounts, complimentary months, promotional offers and benefits granted to the original Member shall not transfer to the new member unless the Club agrees otherwise in writing.
  3. A transferred Membership shall remain subject to the right of suspension in accordance with applicable laws, these Terms and Conditions, and the remaining Membership term.

(5): Membership Suspension

  1. The Member shall be entitled to request suspension of the Membership as follows, provided that the suspension period in each case does not exceed twenty-five per cent (25%) of the Membership term:
    • One-month Membership: one suspension for a period not exceeding seven (7) days.
    • Three-month Membership: two suspensions with an aggregate period not exceeding twenty-two (22) days.
    • Six-month Membership: three suspensions with an aggregate period not exceeding forty-three (43) days, which may be split.
    • One-year Membership: four suspensions with an aggregate period not exceeding eighty-nine (89) days, which may be split.
    • Memberships of one year or more: four suspensions, provided that the total suspension period does not exceed twenty-five per cent (25%) of the Membership term.
  2. A suspension request shall be submitted through the Club’s official channels, and the Club shall confirm to the Member the suspension start and end dates.
  3. The Member shall not be entitled to use the Club’s facilities during the suspension period, and such period shall not be counted as part of the Membership term.
  4. If the Member sustains an injury within the Club that prevents the Member from exercising, the Member shall be entitled to suspend the Membership for the period stated in the medical report. If the medical report establishes that the Member is unable to exercise for the remainder of the Membership term, the Member shall be compensated for the remaining period in accordance with applicable laws.
  5. After the statutory suspension entitlement has been exhausted, the Club may, if it offers such service, approve an additional suspension request for thirty (30) days for a fee of SAR 120, inclusive of VAT, per request, provided that this does not prejudice the Member’s statutory rights.

(6): Use of Facilities and Access

  1. The Member shall be entitled to use the branch or branches and facilities available under the Member’s membership category, as specified in the Membership Agreement.
  2. A Home Membership shall be limited to the branch registered in the Membership Agreement and shall not grant access to other branches unless the membership category or the Club’s approval provides otherwise.
  3. The Member shall present the membership card or approved verification method upon entry.
  4. Membership is personal and may not be lent, sold or made available for use by any other person.
  5. Lockers are intended for daily use unless a locker rental has been agreed. The Member shall empty the locker at the end of each visit. The Club may remove unattended belongings in accordance with its announced procedures.
  6. The storage of prohibited or hazardous materials, or valuables, in lockers is prohibited. The Club shall exercise reasonable care in protecting its facilities and shall not be exempt from liability for damage caused by its negligence or breach of its legal obligations.

(7): Health, Safety and Liability

  1. The Member acknowledges having been informed of the nature of sporting activities and that participation shall be within the Member’s physical capabilities. The Member shall notify the Club of any medical condition or injury that may affect the Member’s ability to participate safely in sports activities.
  2. The Member is advised to consult a physician or qualified specialist, where necessary, before commencing any fitness programme, particularly before engaging in combat sports such as Mixed Martial Arts (MMA) and Brazilian Jiu-Jitsu (BJJ).
  3. The Member shall refrain from using the facilities if suffering from a contagious illness or any condition that may endanger others.
  4. The Club shall take reasonable safety, hygiene and supervision measures appropriate to the nature of the activity. The Member shall comply with coaches’ instructions and announced safety procedures.
  5. Combat sports involve the potential for physical contact and injury. The Member shall wear appropriate clothing and protective equipment and follow the coach’s instructions. This shall not limit the Club’s statutory liability for negligence or breach of its safety obligations.
  6. The sale, promotion, possession or use of prohibited performance-enhancing substances or narcotic drugs within the Club is strictly prohibited. The Club may take all necessary measures to protect safety, terminate the Membership or permanently ban the offending person from entry where a serious violation is established, and notify the competent authorities where appropriate.

(8): Combat Sports Training

  1. Participation in MMA, BJJ and other combat sports training shall be subject to the assessment and instructions of the qualified coach.
  2. The Member shall attend wearing suitable clothing and protective equipment and shall not train or spar beyond the Member’s level or contrary to the coach’s instructions.
  3. The coach may temporarily prevent the Member from participating where the Member’s health condition, conduct or failure to comply with instructions may endanger the Member or others.

(9): Children and Youth Programmes

  1. These Terms and Conditions shall apply to children’s and youth programmes to the extent consistent with the nature of the programme and the child’s age.
  2. The child shall attend scheduled sessions only and comply with attendance times, the coach’s instructions and safety rules.
  3. The child must arrive at the scheduled time. A grace period for lateness of no more than five (5) minutes shall apply, and the coach may refuse entry to a late child where the lateness affects the safety or orderly conduct of the session.
  4. Children and young persons, particularly those between twelve (12) and fifteen (15) years of age, must be appropriately supervised while within the Club’s facilities and may not remain unattended.
  5. Parents or guardians shall not be permitted to enter or remain in the training area during a session except with the Club management’s approval or where required by law or in an emergency.
  6. Communication with the parent or guardian shall take place through the Club’s official approved channels, including official WhatsApp groups where designated for the relevant programme.
  7. The Club may temporarily suspend a child from a session for safety-related reasons or serious misconduct, provided that the parent or guardian is notified of the reason and the action taken.

(10): Conduct and Discipline

  1. The Member shall wear appropriate sports attire, maintain personal and general hygiene, respect staff and other members, and preserve the Club’s facilities.
  2. Abusive, dangerous, unlawful or non-compliant conduct, or conduct that compromises the safety of members or staff, is prohibited.
  3. Providing personal training or sports coaching to others within the Club without the Club’s prior written authorisation is prohibited.
  4. Photographing or recording individuals without their consent, and the Club’s consent where applicable, is prohibited. Photography or recording in changing rooms and restrooms is strictly prohibited.
  5. Where these Terms and Conditions are breached, the Club shall issue the Member with written or electronic notice and grant the Member a period of not less than five (5) business days to remedy the breach where it is capable of remedy.
  6. The Club may take immediate action in the event of serious breaches, circumstances threatening safety, violations of law, or matters involving prohibited substances.

(11): Club Operations and Closure

  1. The Club may amend operating hours or temporarily close part of its facilities for maintenance, events or safety reasons, while providing notice to Members where reasonably possible and without prejudice to its material obligations towards them.
  2. Except in cases of force majeure and closure periods disclosed in advance in the Membership Agreement, the Club shall compensate the Member for days during which the Club’s facility is closed.
  3. If the closure of the Club’s facility continues for more than one month, the Member may terminate the Membership and obtain a refund of the amount due in respect of the remaining Membership term, in accordance with applicable laws.

(12): Termination and Refunds

  1. The Club may terminate the Member’s Membership only in the circumstances specified in the Membership Agreement or these Terms and Conditions, including:
    • Provision of materially inaccurate information.
    • Misuse of the Membership or allowing another person to use it.
    • Breach of safety requirements or applicable laws.
    • Serious or abusive conduct.
    • Possession, use or promotion of prohibited substances within the Club.
  2. Membership may not be terminated for a remediable breach unless the Member has been notified and granted a period of not less than five (5) business days to remedy the breach, unless the breach is serious, poses a safety risk or constitutes a violation of law.
  3. The Member shall be entitled to terminate the Membership and receive a refund of the amount due for the remaining term if the Club breaches a material obligation and fails to remedy such breach within a reasonable period after receipt of notice, in the closure cases set out in Article (11), or in any other cases prescribed by applicable laws.
  4. Any termination or refund shall be documented in writing or electronically, and the Club shall explain to the Member the basis for calculating the amount due and the timeframe for processing the request.
  5. The Member’s statutory rights shall not be waived or limited by any provision of these Terms and Conditions or the Membership Agreement that conflicts with applicable laws.

(13): Privacy and Photography

  1. The Club shall collect personal data necessary to enter into the Membership Agreement and manage services, safety and communications. The Club shall maintain the confidentiality of such data and shall not use or disclose it except for legitimate purposes, to legally authorised entities, or with the Member’s consent where required.
  2. The Club shall not use the Member’s photographs or visual recordings for marketing purposes without obtaining the separate and explicit consent of the Member or, where applicable, the Member’s parent or legal guardian.
  3. The Member may withdraw consent to the marketing use of photographs or recordings through the announced channels, unless there is a legal basis for retaining them.

(14): Final Provisions

  1. The Club may update these Terms and Conditions for regulatory, operational or legal reasons after clearly announcing such updates. No update shall apply to existing Memberships if it results in an increase in fees, reduction of the Membership term, or diminution of agreed benefits or rights, unless the Member consents or the update is required to comply with a mandatory legal obligation.
  2. If any provision of these Terms and Conditions conflicts with applicable laws, the Consumer Protection Charter for Sports Centres and Gyms, or any other mandatory regulation, the applicable legal provision shall prevail and the remaining provisions shall remain valid and enforceable.
  3. These Terms and Conditions shall be governed by the laws of the Kingdom of Saudi Arabia, without prejudice to the right of either the Member or the Club to refer any matter to the competent authorities. In the event of a dispute, the courts of Riyadh shall have territorial jurisdiction.
